While airbags are in place to help protect us in dangerous car crashes, they can also be very dangerous if they fail or are faulty. Airbags can save lives and are integral in the safety aspects and ratings of most cars. However, sometimes those who sell, design, or manufacture them are careless about them. Also there are instances where mistakes can take place. In these cases, it can be extremely dangerous, causing severe and chronic neck, back and head problems, paralysis and even death. These devices are held to a certain standard because of their importance in an accident and when they are not properly handled or if there is something wrong with the device itself and someone is injured or killed, those responsible need to be held accountable and the victim and their families are entitled to compensation and justice.
Over the past 18 years, there have been 284 confirmed fatalities due to airbag malfunction in an accident. Of these, 91 were adult drivers and 28 were children that were properly restrained in rear facing car seats. This data comes from the National Center for Statistics and Analysis of the National Highway Traffic Safety Administration. This does not include numbers of those who were either paralyzed or otherwise seriously injured and also does not include those who may now have chronic back and neck problems and possibly even chronic head conditions due to an airbag malfunction.
There are several things and factors to take into account when considering airbag malfunction as the cause of an injury. These factors include, but are not limited to:
- The airbag itself being defective
- Is the design faulty?
- Was the airbag itself at fault as opposed to the accident?
- The severity of the injuries sustained by the victim
We also take into account where the malfunction occurred. There could have been a mistake at the design level of the process. There can also be a mistake or incorrect assembly at the factory level. There can also be a problem with how the airbag is placed into the vehicle or how the vehicle is designed around the airbag. All of these cases are different and must be approached in a different way and have different laws that go along with them. This is why it is imperative to call a law firm who has experience and knowledge in these cases and can make sure that you get all the compensation you are entitled to and ensure that the responsible party is held accountable as well.
Again, if you or someone you know may be a victim of an airbag malfunction, please call Stopperich Turturice & Logue at (724) 350-8995 so that we can help you to get the justice you deserve.
